Protect your investors and QOF before 12/31

Your investors got a tax break for funding this project. To keep it, the rules ask for proof. A written plan. Dated records of money in and money spent. This tool keeps that proof for you. Add amounts with dates as money moves, then sign one simple record for your CPA and attorney. About fifteen minutes to set up.

Nothing is filed or sent today. This builds the proof at your pace.

The written plan

You need a written plan which says how much money the project will use and by when. Its total sets your two December targets for special tax treatment.

Do you have a written spending plan?

Add the money that arrived

List each deposit that landed in the company’s account for this project. This total needs to add up to 10% of your plan total for your safe harbor tax treatment.

Month, day, year.
Add a deposit the day it lands or three at once in November. Each row carries its own date.

Add bills the company has paid

You need to list the money that paid for costs, at least the major items. This total needs to add up to 5% of your plan total for your safe harbor tax treatment.

Month, day, year.

Add contracts the company has signed

List signed contracts the company is bound to pay. Together with paid bills this needs to add up to 5% of your plan total for your safe harbor tax treatment.

Month, day, year. The signing date decides whether it counts this December. A contract marked not sure on binding does not count until it is confirmed.

Your amounts are confirmed

Select a fund

Every fund keeps its own plan, records, and report. Pick one to continue, or add another.

Add how you use and hold funds

The last thing a plan requires is a statement on how it uses and holds money. Tell us what the money will pay for and how the company holds it before it is spent. Plain answers are enough, and they become the plan’s sentences.

Tap the common uses to build the sentence, or type your own. Plain language is enough. Describe the property, project, construction, equipment, startup, or business costs covered by the plan.
Unspent money must be held in one of these forms to stay inside the safe harbor. Your answer becomes a sentence in the written plan. Not sure leaves the sentence out.

The certificate

Complete your safe harbor report below. If the tax office ever asks, the burden is on you to prove the plan was followed. This page and its dated entries are that proof.

The company this names

What the certificate says

Your attorney owns the final wording and may adapt it. Nothing here claims the rules are satisfied; it records what is on file and who should read it.

Sign it

Typing your name here is the signature that goes on the certificate.

Your documents are ready

Keep adding entries as money moves. The December 31 certificate is a separate signature after the year ends.
